Terms of Use for eSignature Feature in Millipede App

1. eSignature Overview

The eSignature feature allows users to digitally sign SmartDocuments within the Millipede app. By using this feature, you agree that the digital signature you provide is legally equivalent to your handwritten signature.

• If you configure an eSignature, it will be applied to any relevant documents as your official signature.

• If you do not configure an eSignature, your documents will be signed with an automatic placeholder signature: "(e-signed)".

2. User Responsibility

Your Millipede account and eSignature are intended solely for your personal use. You are responsible for maintaining the confidentiality and security of your account, login credentials, and any signature created within the app.

• You are prohibited from sharing your account credentials, signature, or access to the eSignature feature with others.

• You are solely responsible for any unauthorised use of your eSignature if your account or credentials are shared or compromised. Millipede cannot be held liable for any misuse, fraud, or forgery that results from account sharing or unauthorised use of your signature.

 

3. Accuracy and Legitimacy of eSignatures

By using this feature, you confirm that the signature applied to any SmartDocuments reflects your true intent to sign the document.

• You must ensure that the information and signature provided are accurate and legally valid.

• Millipede is not responsible for verifying the authenticity of any signatures or the identity of users applying signatures.

4. Legal Effect of eSignature

Digital signatures applied using the Millipede eSignature feature have the same legal force as a handwritten signature. It is your responsibility to ensure that eSignatures comply with any applicable laws, regulations, or agreements, including those in your jurisdiction.

• Millipede does not guarantee that the use of eSignatures will meet legal or regulatory requirements in all locations or under all circumstances.

5. Forgery and Fraudulent Use

Millipede will not be held liable for any losses, claims, or damages resulting from the forgery, falsification, or misuse of an eSignature. Users are advised to take necessary precautions to protect the integrity of their digital signature and ensure that their account is not accessed by unauthorised persons.

• In the event of suspected forgery or misuse, it is your responsibility to report the incident to Millipede immediately.

6. Limitation of Liability

Millipede is not responsible for any direct or indirect damages, losses, or disputes arising from the use of the eSignature feature, including but not limited to legal disputes, data breaches, or financial losses caused by the misapplication of a digital signature.

• Use of the eSignature feature is at your own risk, and Millipede makes no warranties regarding the availability, accuracy, or security of the feature.

7. Privacy and Data Security

Millipede is committed to protecting your privacy and ensuring the security of your eSignature. Any personal data or eSignature information collected through the app will be processed in accordance with our Privacy Policy.

• Millipede will not store your eSignature unless explicitly required by the user.

• We use encryption and other security measures to protect your signature and personal information, but we cannot guarantee absolute security.

8. Modification of Terms

Millipede reserves the right to modify these Terms of Use at any time. Users will be notified of any changes via the app or email, and continued use of the eSignature feature after changes indicates acceptance of the updated terms.
